The terms and conditions set forth below (hereinafter referred to as the "Agreement") constitute a contract between Port 80 Co., Ltd. and its affiliated companies (hereinafter referred to as "Silverman"), as the provider of websites and various applications under the name Silverman, and the user or member of Silverman (hereinafter referred to as the "User") as the service user.

Please read this Agreement carefully and completely in order to acknowledge and understand the rights and duties of the service provider and the User for the maximum benefit of the User.

This Agreement governs and prescribes guidelines for the use of services on Silverman's website and various applications, subject solely to the policies and discretion of Silverman. The terms and conditions are as follows:

1. The use of Silverman's website or application is subject to the condition that the User agrees to accept the terms and conditions of this Agreement without any modification or exception different from what is stated herein. The User shall not be deemed permitted (whether directly or indirectly) to use or access services on Silverman's website or application unless the User has expressed intention to accept all terms and conditions specified in this Agreement prior to commencing use of the service. If the User does not accept these terms or conditions, Silverman will not permit access to its website or application services and shall not consider such person as a User of Silverman and shall not be responsible for any damages that may arise from the use of Silverman's website or application.
2. Silverman is a platform providing space within the application and on the website to act as an intermediary for communication between the juristic entity of the project or the person responsible for project management and the project members. This enables communication, announcements of information, submission of complaints, maintenance requests for common areas or private areas, booking of common area facilities, notification of various expenses, parcel notifications, participation in meetings and voting, publicizing project activities, and displaying the performance results of project management to project members. The service of the provider does not include the accuracy of information appearing on the application or website. Silverman does not manage or operate any residence or project of any member. It acts only as an intermediary in displaying and providing information to website Users.
3. The User's access to use or services, downloading the Silverman application, posting announcements, receiving notifications, communicating with the juristic entity or project manager, registering membership, clicking any menu command, or proceeding to the next page on the Silverman website or application shall constitute the electronic signature of the User, representing the User's intention that they have thoroughly understood and agreed to comply with all terms and conditions specified in this Agreement and various regulations under Silverman's policies in all respects.
4. The entire website and application platform of Silverman, including all intellectual property rights related to the platform, member accounts, data, content, and services on the website and application, are the sole property of Silverman. The User is granted only a limited, non-exclusive, and revocable right unless otherwise specified in this Agreement. Intellectual property rights relating to content posted by the User belong to the User or relevant licensor. In respect of personal data of Users that are granted access to use the Silverman operating system, Silverman records and retains such data in the system in its capacity as custodian and processor of personal data of other persons who have given consent to receive services or convenience from the service provider. Ownership of personal data remains with the personal data owner, who has the exclusive right to withdraw consent for retention and processing at any time in accordance with the law. Therefore, Users of the Silverman operating system shall not claim ownership or copyright in the personal data of the data owner, except for other types of data arising from independently compiled and developed datasets for recording and analytical processing, which must be clearly notified to the service provider in advance.
5. Silverman does not guarantee the accuracy of information appearing on the website and application because some information is jointly created by service users and website Users themselves, such as project announcements. Silverman therefore disclaims any legal responsibility toward website Users, juristic entities, project managers, project members, or any other persons who suffer loss or damages, whether direct or indirect, arising from information appearing on the website. However, if Silverman receives notification or complaint that certain information causes damage to any person, Silverman reserves the right to consider such information as appropriate, which may lead to suspension of its publication as deemed appropriate. The User who created such information shall remain responsible for damages to such person.
6. Users of the Silverman website are prohibited from committing any act that infringes or insults the nation, religion, or monarchy, and are prohibited from sending or writing vulgar, obscene, defamatory, sarcastic, harassing, threatening, or extortionate messages toward others, including any other messages contrary to law and public order.
7. Information on the Silverman website and application created by Users must be truthful. The creator agrees not to intentionally provide false information or mislead others, not to falsify user information, not to infringe copyright, not to claim endorsement or support by Silverman without authorization, and not to perform any act that threatens or disrupts the website's operation. If a User commits such acts, the User agrees to compensate damages to the injured party in both civil and criminal aspects solely by themselves.
8. Users must maintain their login information securely. If any improper act occurs on the website or application, whether by the User or by others accessing through the User's account, the User shall be responsible for such case.
9. Silverman may suspend member accounts without prior notice, particularly where such member violates the terms and conditions of use. The decision of Silverman's officer shall be final. Members have no right to claim any damages from Silverman.
10. The User acknowledges and accepts that financial transactions such as payment of common fees, water fees, electricity fees, or other expenses conducted through www.silverman.app and subdomains, or through the SILVERMAN application on iOS or Android mobile devices or other mobile devices, the service provider shall not be responsible in the event of any error or damage arising from such financial transactions, whether civil or criminal, because the service provider's duty is only to provide space for communication between the User and financial service providers.
11. Silverman has the right to immediately terminate service without any condition if the User uses a fake credit card or a stolen credit card without authorization from the card owner to purchase services.
12. Silverman reserves the sole discretion to suspend User accounts and/or suspend other services in whole or in part at any time in the following cases:
    (a) Where the service provider believes it is necessary and/or wishes to maintain the security of the User's account;
    (b) Where any transaction is detected and considered by the service provider alone to be contrary to this Agreement or security requirements, or where there is reasonable suspicion of fraud or unlawful act;
    (c) Where any transaction is conducted for commercial gain or profit through the website www.silverman.app or the Silverman application, such as advertising or acting as intermediary in property sales within a project.
    If the account is suspended under the above reasons, the User may resume normal service once the cause of suspension has ceased.
13. Silverman has the right to inspect, modify, amend, delete, or add any information on the website and application, including content created by Users, as deemed appropriate. Silverman's decision shall be final. Users have no right to claim damages, except in relation to personal data under the Personal Data Protection Act B.E. 2562 (2019).
14. All information appearing on the website and application is the copyright of Silverman exclusively. No person may reproduce, modify, or alter it in whole or in part without authorization. Such action constitutes an offense under the law, except for personal data under the Personal Data Protection Act B.E. 2562 (2019) or where written permission is granted by Silverman.
15. Silverman shall not be responsible for any damages arising from the use of the website, whether direct or indirect, in all cases.
16. Silverman is the owner of the application copy and all content, even after installation on mobile phones or similar devices. The User is granted only a license to use the application or services.
17. Registered project domain names cannot be changed. If the User wishes to obtain a new project name, the User must pay for a new domain registration service.
18. Silverman will activate the service within 24–72 business hours after receiving proof of payment with complete required information for opening a new project. If payment is made but incomplete details are provided (such as tax ID, juristic manager name, contact number) or there is no contact within 1 month, the provider must cancel the order.
19. Silverman has no refund policy under any circumstances, except in cases of breach by the service provider.
20. Silverman will provide service expiration notifications periodically. If payment is not made within 7 days, the provider must temporarily suspend service. After 30 days of expiration, the provider must remove User data from the system permanently without the ability to retrieve it.
21. Silverman will contact Users via the email used for purchase. If changing administrator or contact email, notification must be sent from the original purchase email. If unable to use the original email, additional documents such as company affidavit, tax ID certificate, receipt, etc., may be required. Without such documents, the provider reserves the right to consider whether to provide information or assistance in any case.
22. Any files uploaded by the User on Silverman, such as PDF files, Word files, Excel files, photo files, etc., if infected with a virus, will be automatically deleted from the system without prior notice.
23. Silverman reserves the right to amend, improve, add, or change these terms and conditions without prior notice. Silverman's decision shall be final. Users have no right to claim any damages from Silverman.
